1. Processing of personal data.

3. Processing purpose.

We process the mentioned types of personal data:

    1. primarily to provide, document, and invoice our agreed-upon services.
    2. for marketing purposes (using any communication methods such as email, social media, mail, or telephone) to inform about publications, events, news, services, or products that might be of interest (e.g., through a newsletter).

4. Disclosure.

To achieve the purposes described in this Privacy Policy, it may be necessary for us to share personal data with the following categories of recipients: external service providers, clients, opposing parties and their legal representatives, business partners with whom we may need to coordinate our service delivery, as well as authorities and courts. 6.6 We use Matomo, hosted by analytics.hostkonzept.ch and operated by konzeptplus ag, for analyzing website usage. Data is stored exclusively in a Swiss data center under Swiss data protection regulations. You can opt out of Matomo analytics by adjusting your browser settings.

7. Job application.

If you apply for a position with us, we collect and process the relevant data for the purpose of reviewing your application, conducting the recruitment process, and, in the case of successful applications, preparing and concluding the corresponding contract. In addition to your contact details and information from the related communication, we process the data contained in your application documents and any additional data we may obtain about you, such as from professional social networks, the internet, media, and references, provided you consent to us obtaining references.

8. duration of data storage and data backup.

We store personal data only for as long as it is necessary to manage the business relationship, fulfill legal retention and documentation obligations, or if we have an overriding private or public interest. We take reasonable and proportionate measures to protect personal data from loss, unauthorized alteration, or unauthorized access by third parties. If you provide us with personal data through a third party (e.g., your employees or other contacts), it is your responsibility to inform them in a general manner about the processing by us or other external service providers (e.g., in a privacy policy for employees).

9. External services.

We would like to inform you that, in the course of managing mandates, we rely on external IT service providers and cloud providers with servers located in Switzerland. We also use certain IT services and communication tools that may be associated with data security risks (e.g., email, video conferencing). It is your responsibility to inform us if you require specific security measures.

10. Interest in processing.

We have a legitimate interest in processing personal data in line with the stated purposes. Some processing activities are also necessary for us to fulfill our contractual obligations to you or comply with our legal obligations (e.g., retention requirements).

11. Your rights.

Affected individuals have, in particular, the right to access their stored personal data and the purpose of its processing, the right to rectification, and the right to deletion or restriction of the processing of their personal data. They also have the right to object to the processing, the right to seek legal remedies with a competent supervisory authority, and the right to data portability. Please note, however, that these rights are subject to conditions and exceptions. To the extent legally permissible or required, we may deny requests to exercise these rights. For instance, we may be required or permitted to retain or further process personal data despite a request for deletion or restriction of processing for legal reasons. No consent from clients, their employees, or other contacts is required for this Privacy Policy. The Privacy Policy merely serves to inform about the nature, scope, and purpose of the use of personal data by AGON PARTNERS SOLUTION GmbH. AGON PARTNERS SOLUTION GmbH reserves the right to unilaterally amend the content of the aforementioned Privacy Policy at any time. We will inform you accordingly of any changes.

13. DSGVO.

Should the EU General Data Protection Regulation (GDPR) exceptionally apply to certain data processing activities, the following shall also apply exclusively for the purposes of the GDPR and the data processing activities subject to it. We base the processing of your personal data in particular on the following grounds:

a. it is necessary for the initiation and conclusion of contracts, as well as their management and enforcement (Art. 6(1)(b) GDPR);


b. it is necessary for the protection of legitimate interests of ours or third parties, specifically for communication with you or third parties, to operate our website, improve our electronic offerings, and register for specific services and offerings, for security purposes, compliance with Swiss law and internal regulations, risk management, corporate governance, and other purposes such as training, administration, evidence and quality assurance, organization, execution and follow-up of events, and to protect other legitimate interests (Art. 6(1)(f) GDPR);


c. it is required or permitted by law under EEA law or the law of a member state based on our mandate or position (Art. 6(1)(c) GDPR).
